A Guide to Combat Pay in the United States Military A Guide to Combat Pay in the United States Military As of 2018, a military member assigned to or deployed to a combat zone receives bonus combat pay (officially called hostile fire or imminent danger pay), at a rate of $225 per month. It is in addition to their regular pay rate. Being assigned to or working in a combat zone  also triggers a tax advantage in some locations. Congress and/or the president can designate combat zones as Tax Exempt areas. Earnings received while in these combat zones are not subject to federal tax withholding. Rules for Military Hazardous Duty Pay This exclusion is unlimited for enlisted members and is limited to the maximum enlisted pay amount for officers and warrant officers. If you spend a single qualifying day in the combat zone, your pay for the entire month is excluded from taxable income, and you receive $225 in combat pay for that month. Any other bonuses and special pay you receive will also be excluded from federal tax withholding if you earn them while in a combat zone. For example, a reenlistment bonus is excluded from taxes if the member reenlists in the same month in which the member also served in a combat zone. Since there is no limitation on amounts excluded for enlisted members, the entire reenlistment bonus would be excluded. As another example, an officers flight pay would also be excluded from taxable income, but only up to the point which basic pay and the flight pay do not exceed the maximum enlisted pay amount. Hazard Pay and Other Allowances In addition to imminent danger pay and the tax exclusion, some areas qualify for a special monthly allowance called hardship duty pay. Military members with dependents also receive a Family Separation Allowance (FSA) of $250 per month any time they are away from their families due to military orders for 30 days or longer. Finally, members in a combat zone are authorized to deposit up to $10,000 (per year) of their pay and allowances into a special savings account  that pays a guaranteed 10 percent interest per year. This program was established during the Vietnam era and then phased out at the end of the Vietnam War. However, it was revived in 1991 during the Gulf War, and the program still exists today. In addition to the combat zones listed below, personnel stationed in Kazakhstan and Turkmenistan are eligible to use the tax-free program if they are supporting combat operations in Afghanistan, even though they are not physically in Afghanistan. In hindsight, I often wonder what it would have been like if the job descriptions I read were any different from all of the others.The fault isn’t on others though, I didn’t ask the right questions and I didn’t do my homework. I didn’t change more than a few lines on my CV and I didn’t put in that extra effort.And I’m not alone.The job-seekers I speak with today are all thinking the same thing: they’re thinking that each job description looks as good as the last and that they’d be lucky to have a job at *insert great brand here.* The looks of the job description don’t articulate what the experience is going to be like on the job. Similar to knowing that there is no way to understand what cilantro will taste like just by looking at it.Now talking to new grads or people who are looking for new jobs, I hear the same thing over and over. I hear people who are looking for a job that aligns with who they are and are left clueless when they’re looking to apply. Even today, a job description doesn’t really describe the job, it just talks about the skills and requirements needed to do the job. The opportunity is to talk more about the experience while on the job. The opportunity is to know more about what our lives would be like as a result of the job rather than just what the skills we need to do it are.While cilantro isn’t for everyone, jobs shouldn’t be either. And to fix it, we need to be talking about what the experience is going to be while on the job, and not just the skills and experience needed to do the job, along with Value ‘statements’ like Integrity, Honor, Respect (like anyone is going to not self-identify as respectful and honorable). If we can start talking more about the experience one might have while on the job and focus less on the image of the job and what it appears to be, maybe we can all make more educated decisions. If we can see what the office design is like, what work will look and feel like, if there are remote or flex opportunities, who our teammates are and what they value, if we’re going to be in meetings on the computer most of the day, then I think we’ll be getting a lot closer to knowing if there is a fit or not.See, it isn’t about right and wrong when it comes to culture and experience; it comes down to what is true and untrue. It isn’t about attracting males vs females, or Millennials vs. Gen Z (or other generations), f or example, it is about attracting people who have more education about the position and what the experience would be like if they were to work there or not.It is a dream of mine that we actually like the work we do, and to do that, we need to know more about the position than the perks present and the skills needed to do the job. If people knew enough about the job, perhaps we can reverse this trend where job-seekers (myself included) will apply nearly blindly to tens of jobs without really knowing what we’re applying for. The more we know about a position and the experience while in it, the better our decision will be. Ownership is critical in determining who has the right to exploit any patents ultimately issued on such inventions. Accordingly, the employee engineer should be familiar with the principles governing ownership and patent rights. A U.S. patent grants to the patent owner (or patentee) the right to exclude others from making, using, offering for sale, or selling the invention throughout the United States or importing the invention into the United States . . .. 35 U.S.C. 154, 271. Examples of exploiting patent rights include selling products or services covered by the patent, assigning the patent to another, or granting limited rights under the patent to others, such as by licensing. The general rule is that an individual owns the patent rights to the subject matter of which he is an inventor, even though he conceived it or reduced it to practice in the course of his employment. Banks v. Unisys Corporation, 228 F.3d 1357, 1359 (Fed.Cir. 2000). An invention may have joint inventors, even though the inventors did not each make the same type or same amount of inventive contribution. 35 U.S.C. 116. If there is no agreement to the contrary, any of the joint owners are free to make, use or sell the patented invention without the permission of the other owners and without accounting to the other owners. 35 U.S.C. 262. Without an accounting means that each inventor has an unfettered right to exploit the patent and cannot be forced to share any profits obtained from his activities. However, a patent is a personal property right, which may be assigned, licensed and/or mortgaged in whole or in part. 35 U.S.C. 261. Contract law allows individuals to freely structure their transactions and employee relationships. An employee engineer may thus contract to assign all rights in inventive ideas to the employer. Teets v. Chromalloy Gas Turbine Corp., 83 F.3d 403, 407 (Fed.Cir. 1996), cert. denied, 519 U.S. 1009 (1996). Furthermore, many employers require engineers to sign writtencontracts expressly allocating patent rights between engineers and employers. Most states enforce these contracts, which can transfer all of the inventors rights in the invention to the employer in return for continued employment of the employee, although some states do place restrictions on such contracts. If there is no agreement to the contrary, the employee engineer rather than the employer owns the invention, including the patent rights pertaining thereto. However, there may be an implied agreement to assign the rights to the invention. The general rule of employee ownership is subject to various exceptions such as where the employer may be deemed to own a invention made by an employee engineer who was hired for the specific purpose of making the invention, or who, after being hired, was directed by his employer to make the invention. Standard Parts Co. v. Peck, 264 U.S. 52 (1924); Houghton v. United States, 23 F.2d 386, 389-390 (4th Cir. 1928), cert. denied, 277 U.S. 592 (1928). The general rule is also subject to the limitation that the employer may be deemed to have a shop right in the invention, pursuant to which the employer enjoys an implied, nonexclusive, irrevocable and royalty-free license to use the invention made by the employee engineer. McElmurry v. Arkansas Power Li ght Co., 995 F.2d 1576, 1580-1581 (Fed. Cir. 1993). Various other exceptions exist providing employer ownership, which are beyond the scope of this article. As discussed above, determining ownership rights can be difficult but is of paramount importance. The first step includes identifying each inventor. Where multiple inventors exist the rights between these inventors must also be determined. The second step involves determining whether the various inventors have expressly or impliedly contracted away their rights to the invention. Where there is a written agreement, it should be carefully reviewed to determine how rights have been allocated. Where there is no written agreement, the engineer inventor may face a murky area in ferreting out proper allocation, which depends upon the facts and circumstances surrounding the inventive activity. Particular attention should be paid to these issues because of their impact on the ability to exploit a particular invention.
